State Leave Bank Information
The State Leave Bank Program is available to employees who are in need of leave due to a serious and prolonged medical condition. Employees must meet the following criteria to receive donated leave:
• Must have a serious and prolonged medical condition;
• Must be an active member of the State Leave Bank;
• Must have exhausted all forms of annual, sick, personal, and compensatory leave;
• Must have received a satisfactory performance rating;
• Must provide sufficient medical documentation to substantiate absence for the time period requested;
• Must have received less than 2,080 hours of donated leave (Leave Bank and Employee-to-Employee);
• Must not have a record of sick leave abuse (must not have been on a one-day sick slip restriction within the past two years);
• Must be able, in all likelihood, to return to work.
No. Employees must exhaust their annual, personal, sick, and compensatory leave before requesting donated leave.
No. Employees may use donated leave for a continuous absence only. If leave is needed for treatment of a catastrophic medical condition (such as cancer), please contact the Leave Coordinator with the Office of Human Resources.
Employees may enroll in the State Leave Bank within the first 60 days of employment or during the Open Enrollment period. An 8-hour donation of annual, personal, sick*, or a combination thereof, is required for membership. Employees who donate sick leave must have a remaining balance of 240 hours after the donation has been made. Membership is for two years; re-enrollment is required.
Donated leave should be requested once all accrued leave has been exhausted and at the time of need. Requests submitted once you have returned to work will be denied by the State Leave Bank.
The request packet can be found on the Department of Budget and Management’s State Employees Leave Bank Program website.
Employee should submit the following documentation for a complete request:
• State Employees’ Leave Bank Request Form (MS-408)
• State Employees’ Leave Bank Medical Certification Form (MS-402)
• Authorization Form for Review of Released Records & Information (HIPAA Form)
• Medical documentation that addresses and supports your work absence
The State Leave Bank will forward a determination within 30 days of receipt.
Employees who are members of the State Leave Bank must request donated leave from the Leave Bank if it is for a medical condition of their own.
Members of the State Leave Bank may request employee-to-employee leave donations only if the request is for a catastrophic illness or injury of a member of the employee’s immediate family for whom the employee is needed to provide direct care.
A catastrophic illness or injury is defined as “a condition that is incapacitating or life-threatening as certified by a health care provider.
New members must wait 90 days after enrolling before requesting leave from the State Leave Bank. Existing members can request leave at the time of need.
No. Donated leave will be granted temporarily until we receive the State Leave Bank’s decision. If the request is denied by the State Leave Bank, the temporary leave immediately stops.
The University is required to recover any temporary leave that has been granted if the employee has been denied. At minimum, the employee will forfeit ½ of their sick leave accruals until all temporary leave has been returned. The employee may agree to another method, such as a repayment plan or forfeiture of future accruals.
No. All accrued leave must be exhausted before using donated leave.
Yes, a return date is necessary. A criteria for receiving donated leave is the ability, in all likelihood, to return to work.
Employee-to-Employee leave is donated from your colleagues while State Leave Bank donations come directly from the State Leave Bank.

No, it is the employee’s responsibility to request leave from their colleagues. The Office of Human Resources does not request leave for the employee in need.
Unfortunately, leave can only be donated to members of the State Leave Bank or through Employee-to-Employee leave donations.
Example: An employee needs leave from January 1 through January 5 (40-hour donation is needed). The employee has acquired 24 hours of leave donations from a colleague and submitted this documentation with the leave donation request.
In this instance, the leave request will be partially approved through the date that the 24-hour donation covers. The employee will be required to submit another completed request (extension) if they are unable to acquire all of the hours needed at the time of the initial submission.

Yes, a full-duty return to work date is necessary. A qualification for receiving donated leave is the ability, in all likelihood, to return to work.
